GENERAL PROVISIONS
The data controller of personal data collected via the website www.certynergiapolska.pl is CertyNergia Polska Sp. z o.o., with its registered office at Wiślana 8, 00-317 Warsaw, address for correspondence: Wiślana 8, 00-317 Warsaw, registered in the business register under KRS number 0000678757, NIP: 5252711720, REGON: 367321990, with a share capital of PLN [amount], email address: info@certynergiapolska.pl, hereinafter referred to as the „Administrator,” who is also the Service Provider.
The personal data of the Service Recipient are processed in accordance with the Personal Data Protection Act of August 29, 1997 (Journal of Laws No. 133, item 883, as amended) and the Act on Providing Services by Electronic Means of July 18, 2002 (Journal of Laws No. 144, item 1204, as amended).
The Administrator takes special care to protect the interests of individuals whose data is processed and, in particular, ensures that the data it collects is:

  • processed lawfully,
  • collected for specified, legitimate purposes and not further processed in a way that is incompatible with those purposes,
  • accurate and relevant to the purposes for which it is processed,
  • stored in a form that allows the identification of the individuals concerned, no longer than is necessary for the purposes of processing.

PURPOSE AND SCOPE OF DATA COLLECTION
Personal data of Service Recipients collected by the Administrator is used for:

  • Contacting the Service Recipient (customer).
    The Administrator processes the following personal data of the Service Recipients:
  • First name and last name,
  • Email address.
    The Administrator may also process the following data that characterizes the way the Service Recipient uses the services provided electronically (usage data):
  • Identifiers of the telecommunications network termination or IT system used by the Service Recipient.
  • Information about the start, end, and scope of each instance of using the service provided electronically.
  • Information about the Service Recipient’s use of the services provided electronically.
    Providing personal data as described in point 2 is necessary for the Service Provider to offer electronic services via the website.

LEGAL BASIS FOR DATA PROCESSING
Using the website and entering into agreements for the provision of electronic services via it, which requires the provision of personal data, is entirely voluntary. The individual whose data is concerned decides independently whether they wish to start using the electronic services provided by the Service Provider in accordance with the Terms and Conditions.
According to Article 23 of the Personal Data Protection Act of August 29, 1997 (Journal of Laws No. 133, item 883, as amended), processing of data is permissible, among others, when:

  • the data subject has consented to it, unless it concerns the deletion of data about them,
  • it is necessary for the performance of a contract to which the data subject is a party, or when it is necessary for taking steps before entering into a contract at the request of the data subject.
    Personal data processing by the Administrator always takes place within the framework of the legal grounds for processing set out in point 2. Data processing is related to the execution of the contract or the necessity of taking steps before entering into a contract at the request of the data subject (point 2, letter b).

RIGHT TO CONTROL, ACCESS TO PERSONAL DATA AND CORRECT IT
The Service Recipient has the right to access their personal data and to correct it.
Each individual has the right to control the processing of their data included in the Administrator’s database, in particular the right to request the completion, updating, correction of personal data, temporary or permanent suspension of their processing, or their deletion if they are incomplete, outdated, false, collected in violation of the law, or are no longer necessary for the purpose for which they were collected.

COOKIES
The Service Provider’s website uses cookies. If the Service Recipient does not change the browser settings, this is considered as consent to their use.
The installation of cookies is necessary for the proper provision of services on the website. Cookies contain information essential for the proper functioning of the website, particularly for those requiring authentication.
The following types of cookies are used on the website:

  • Analytical cookies
    „Analytical” cookies help better understand how the Service Recipient interacts with the content of the website, allowing better organization of its layout. These cookies collect information about how the Service Recipient uses the website, the type of page from which the Service Recipient was redirected, and the number of visits and duration of the visit to the website. These cookies do not register specific personal data of the Service Recipient but are used to create statistics about website usage.

FINAL PROVISIONS
The Administrator implements technical and organizational measures to ensure the protection of personal data being processed, appropriate to the risks and the category of data subject to protection, and, in particular, protects the data against unauthorized disclosure, access, processing in violation of applicable laws, as well as against alteration, loss, damage, or destruction.
The Service Provider provides appropriate technical measures to prevent unauthorized individuals from acquiring and modifying personal data transmitted electronically.
